Terms of Service
Effective from your first visit to kenneth-l-carter.myshopify.com
This document sets out the rules that apply to your use of our website and the purchase of any product from it. It creates a straightforward, enforceable agreement between you and Kenneth L Carter.

Clause 3 — Account Security

Clause 4 — Order Formation
A submitted order is your offer to buy. The contract is formed only when we email you the order confirmation. Before that moment, we may decline the order — most commonly because:
- The item is unavailable
- A material error was made in the price or description
- The order shows signs of fraud
- The order breaches these Terms
Where we cancel a paid order, a full refund is issued to the original method of payment.
Clause 5 — Pricing
- All prices are quoted in U.S. dollars.
- Prices may change without prior notice.
- We honor the price displayed at checkout for that specific order.
- In the case of a clearly erroneous price, we reserve the right to cancel rather than fulfill at the wrong price.
Clause 6 — Payment
Payment is due at checkout, using one of the methods offered by our payment processor. By submitting payment details, you confirm that you are the authorized user of the payment method.
Clause 7 — Shipping & Returns
- Shipping — governed by our Shipping Policy.
- Returns and refunds — governed by our Return and Refund Policy.
Both are incorporated into these Terms by reference.
Clause 8 — Product Descriptions
We work to describe every product with accuracy. Small variations in color, finish, or measurement — particularly from screen calibration or natural material variability — are normal and are not treated as defects.
Clause 9 — Intellectual Property
All content on the store — text, images, illustrations, layout, code, and the name "Kenneth L Carter" — is owned by us or licensed to us. Copyright and trademark law in the United States applies.
Permitted:
- Personal browsing
- Sharing links
- Screenshots for personal reference
Not permitted (without written consent):
- Commercial reproduction of any content
- Use of our brand assets in your business
- Bulk copying, mirroring, or scraping of the store
- Modification or redistribution of any part of the store
Clause 10 — Acceptable Use
Do not use the store to:
- Break any law
- Interfere with the store's security, availability, or performance
- Transmit malware, viruses, or automated scraping bots
- Send unsolicited marketing (spam)
- Misrepresent your identity or affiliation
Violations may result in immediate suspension of access.
Clause 11 — Disclaimer
The store and its products are provided "as is" and "as available." We disclaim all implied warranties to the fullest extent permitted by U.S. law, including warranties of merchantability and fitness for a particular purpose. This does not affect your statutory consumer rights.
Clause 12 — Limitation of Liability
Direct claims — Our maximum liability is limited to the amount you paid for the product giving rise to the claim.
Indirect / consequential claims — We are not liable for loss of profits, loss of use, loss of data, business interruption, or any other indirect losses.
Clause 13 — Termination
We may end your access to the store at any time if you breach these Terms.
Clause 14 — Governing Law
These Terms are governed by U.S. federal law and the laws of the state in which our business is registered. Legal proceedings shall be brought in the appropriate state or federal courts of that jurisdiction.
Clause 15 — Updates
We may revise these Terms as our business or the law changes. Revisions take effect on publication. The current version is always available on this page.
